Jenny Wright started working at Ace Hardware, a franchise owned jointly by her mother, Dotty Smith, and her step-father, Don Smith. Within the month, the three made an agreement to have Jenny assume some of the managing responsibilities from her step-father. Jenny was excited to take over part of the managerial paperwork while continuing her role as sales clerk in the business. There was no written agreement to share in the store’s profits, although she took the title, manager. The bank account for the business remained in Don Smith’s name, and there was no change to the tax information with the state. Several months later, Jenny slipped on the sales floor and dislocated her shoulder. The store’s insurer, The Hartford, paid Jenny temporary disability benefits. After returning to work, Jenny was notified that the claim would be changed on the basis of new information that she was co-owner under the agreement with her mother and step-father. The Hartford claim classified Jenny incorrectly as an employee.
